By entering this site or using the services provided via any means, including but not limited to this site, email message or other applications, you consent and agree to the terms contained herein. This also hereby incorporates by this reference any additional terms and conditions posted or provided by Brown and Caldwell through the site, or otherwise made available to you. 

This site is made available for public water agencies, water utilities, and nonprofit organizations, and most private companies are not eligible as the purpose of this service is to help utilities fill critical positions to advance the water quality and environmental health of our world. Job post submissions that are not for public water agencies, water utilities or nonprofit organizations will be refunded the job credit. Brown and Caldwell reserve the right to refuse any job posting for any reason. Brown and Caldwell also may, in its sole discretion and in addition to any other remedies available, with or without cause, withdraw, suspend or discontinue at any time any materials or services available on this site, and any functionality or features in or on this site, with or without notice.

Brown and Caldwell may reject, remove, or limit visibility to any user content, and Brown and Caldwell may disable any account or restrict your ability to use all or parts of the site, for any or no reason without notice. Brown and Caldwell always retains the right to remove any user content or account if we feel it is in our interest or our users’ interest.

Job Seekers

In addition to the general terms of this Terms of Use, job seekers acknowledge and consent to the following additional terms: 

Job seeker acknowledges and understands that Brown and Caldwell has no control over the content of any job ads, links to or from job ads, or any conditions third parties might impose once a job seeker has submitted an application or left Brown and Caldwell’s site. We cannot confirm the accuracy or completeness of any job ad or other information submitted by any employer or other user, including the identity of such employer or other user. Brown and Caldwell assume no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any job ads, or other information submitted by any employer or other user. 

When you create an account or upload your resume, it is searchable by users, and you are requesting and authorizing Brown and Caldwell to make available your resume and information to anyone accessing our site. By uploading your resume or adding preferences or parameters to your profile, you are authorizing Brown and Caldwell to share with you job ads that match your preferences or parameters. Such information, including a copy of your resume, can be downloaded by users. Brown and Caldwell does not control such third parties and assumes no responsibility and disclaims all liability for your resume or application information that you share with employers or otherwise make public. 

By using the site, you agree that Brown and Caldwell is not responsible for the content of the employer’s job application, messages, screener questions, skills assessments or their format or method of delivery, and that Brown and Caldwell does not guarantee receipt of your application by the employer. Please note that Brown and Caldwell does not choose the questions asked by employers or decide the job qualification criteria of employers. Employers posting jobs on the site are solely responsible for compliance with all applicable laws, including the Fair Credit Reporting Act and similar laws, anti-discrimination laws such as Title VII of the Civil Rights Act of 1964, as amended, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and any applicable data protection or privacy laws. Employers posting on the site are responsible for offering alternative methods of screening, if so required by the Americans with Disabilities Act or any similar law. You must contact the employer if you require alternative methods of screening. Brown and Caldwell also does not guarantee the validity of any job offer received and cautions job seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations. Job seekers are solely responsible for verifying the accuracy of any employer or job offer.

Employers

In addition to the general terms of this Terms of Use, employers posting job ads on this site acknowledge and consent to the following additional terms: 

When you access or use the site in your capacity as an employee or other representative of an employer, or if you create an account on behalf of an employer, you represent and warrant that you have the authority to bind the employer to this Agreement. When you create an account on behalf of an employer, the account belongs to the employer, and you acknowledge that any and all information that you provide through the account, such as the actions you take and when you take them, will be visible to the employer. 

You agree that Brown and Caldwell may send notices to job seekers informing them that an employer account has been compromised, including if such account is associated with you. Brown and Caldwell cannot and does not guarantee that such notices will always be sent or received, and you therefore agree that Brown and Caldwell bear no responsibility for doing so. Brown and Caldwell make no warranty regarding, and disclaims any liability for, the accuracy, completeness, timeliness, or reliability of such notices. 

Brown and Caldwell may offer suggestions, recommendations, or information to users that may support or improve their experience on the site. You understand that these offerings are provided as a courtesy and without warranty, and your use of such information is at your sole discretion.  

As an employer, you are responsible for your use of the site and any tools offered therein, including your decisions regarding your job description, the requirements for your job, independently verifying information provided by a job seeker, compliance with applicable laws, including relevant federal, state, and local laws related to job postings, and whom you interview or hire. By using the site, you agree that Brown and Caldwell is not responsible for, nor has any role in verifying the content of a job seeker’s resume, and Brown and Caldwell assume no responsibility and disclaims all liability for any actions you take based on any information provided by a job seeker or Brown and Caldwell. Brown and Caldwell may limit your ability to post a job, or the visibility of your job, however Brown and Caldwell is not responsible for, and you are solely responsible for, compliance with minimum wage and all other legal requirements.
